1Accepting these terms

These Terms of Use (the "Terms") are an agreement between you and ZapFlix ("we", "us") about your use of the website zapflix.me and its related services, including our Telegram channel, group and bot (the "Service"). By visiting or using the Service you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2What ZapFlix is

ZapFlix helps you find and watch films, series and live channels. Title information, posters and trailers come from public sources such as The Movie Database (TMDB) and YouTube. This product uses the TMDB API but is not endorsed or certified by TMDB.

Videos, live channels and many subtitles are retrieved from third-party sources that we do not own or control. We do not upload or permanently store films or episodes. To make playback work on your device, video may pass through or be cached temporarily by our servers. We cannot guarantee that any title, quality, language or subtitle is available, accurate or uninterrupted, and availability may change at any time.

We may change, suspend or stop any part of the Service at any time.

3Who can use ZapFlix

You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use it only with the permission and supervision of a parent or guardian, who accepts these Terms for you. In the European Economic Area, users under 16 need a parent's or guardian's consent to create an account.

Some titles are intended for adults. Age ratings shown on title pages come from third parties and are for guidance only.

You are responsible for making sure that using the Service is legal where you live.

4Your account

• Give accurate information and keep your email address up to date.
• Keep your password secret and do not share your account. You are responsible for activity on your account.
• One person, one account. Do not create accounts automatically or to collect rewards several times.
• Tell us at [email protected] if you believe someone has accessed your account.

You can stop using the Service at any time and ask us to delete your account by writing to [email protected].

5Acceptable use

The Service is for your personal, non-commercial viewing. You agree not to:

• download, record, copy, re-stream, sell or publicly show any video or other content from the Service, or embed our player on other websites;
• use bots, scrapers or other automated tools to access the Service or collect data from it;
• get around playback limits, quality locks, ad breaks, reward rules, security checks or access controls, or tamper with ads or ad measurement;
• try to break into, overload, test the security of or disrupt the Service, its servers or other users;
• upload or send anything that is illegal, infringes others' rights, contains malware, or is hateful, harassing, sexual involving minors or otherwise harmful;
• impersonate anyone or misrepresent your connection with anyone;
• use the Service in any way that breaks the law.

6Ads, rewards and points

The Service is free because it shows ads. You agree that ads may appear before, during and after videos, on live channels and on pages. Ads are provided by advertisers and ad networks, which are responsible for their content; seeing an ad does not mean we endorse the advertised product.

If an ad blocker is detected, some pages or videos may not load until you allow ads on ZapFlix.

Reward points, higher-quality unlocks and other rewards have no cash value, cannot be sold, transferred or exchanged for money, and are personal to your account. We may change the rewards, how points are earned or how long they last. Points or rewards obtained by fraud, automation or abuse may be removed and the account suspended. Points end when your account is deleted.

If we ever offer paid features, separate terms will be shown to you before you pay.

7Content you send us

If you upload subtitles, send reports or comment in our Telegram group, you confirm that you have the right to do so and that it does not infringe anyone's rights. You keep any rights you have in it, and you give ZapFlix a free, worldwide, non-exclusive licence to host, store, adapt (for example re-time subtitles), display and share it as part of the Service. We may review, refuse or remove any content.

8Third-party services and links

The Service contains content, links and embedded services from third parties (for example video sources, YouTube, Google, TMDB, Telegram and advertisers). We do not control them and are not responsible for their content, availability or practices. Their own terms and privacy policies apply when you use them.

9Copyright and takedown requests

We respect the rights of creators and copyright owners and expect our users to do the same.

If you own the rights to a work, or are authorised to act for the owner, and believe it is available through ZapFlix without permission, send a notice to [email protected] with the subject "Copyright notice". Please include:

• your name, postal address, phone number and email address, and if you act for someone else, your authority to do so;
• a description of the copyrighted work;
• the exact ZapFlix page address (URL) of each item you want removed;
• a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
• a statement that the information in your notice is accurate and, under penalty of perjury where applicable, that you are the owner or authorised to act for the owner;
• your physical or electronic signature.

When we receive a complete notice we act quickly, normally within 3 business days, to remove or disable access to the identified material, and we may inform the user who provided it (for example an uploaded subtitle).

If content you provided was removed and you believe this was a mistake or that you have the right to use it, you can send a counter-notice to [email protected] with your contact details, the removed item, and a statement made in good faith explaining why it should be restored.

We suspend the accounts of users who repeatedly infringe the rights of others. Sending a notice that is knowingly false may make you liable for damages.

10Our rights

The ZapFlix name, logo, website design and software are owned by ZapFlix or its licensors and protected by law. Film titles, posters, trailers and other material belong to their respective owners. These Terms do not give you any right to use our name or logo.

11Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, accuracy and non-infringement, to the extent permitted by law. We do not promise that the Service will be uninterrupted, error-free or free of harmful components, or that any content will remain available.

12Limitation of liability

To the extent permitted by law, ZapFlix will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or goodwill, arising from your use of, or inability to use, the Service or any third-party content. Because the Service is free, our total liability to you for any claim is limited to 50 US dollars.

Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence, or for fraud, and nothing affects your mandatory rights as a consumer.

13Your responsibility

If you break these Terms or the law while using the Service, you agree to cover the reasonable costs and damages that ZapFlix suffers as a result, including reasonable legal fees, to the extent permitted by law.

14Suspension and termination

We may suspend or close your account, or block access to the Service, if you break these Terms, if we must do so by law, or to protect the Service or other users. Where reasonable we will tell you why. Sections that by their nature should continue (for example copyright, disclaimer, limitation of liability and governing law) continue to apply after termination.

15Changes to these terms

We may update these Terms. The date at the top shows the latest version. If a change is significant we will give you notice on the site or by email before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms.

16Governing law and disputes

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, and the courts of Amman have jurisdiction over any dispute, unless the mandatory law of your country gives you the right to bring a claim in your local courts or under your local law. Before starting a formal dispute, please contact us at [email protected] so we can try to resolve it informally.

If any part of these Terms is found unenforceable, the rest remains in effect. If we do not enforce a right, we do not waive it. You may not transfer your rights under these Terms; we may transfer ours as part of a reorganisation or transfer of the Service.
